1. About These Terms

These Terms of Service ("Terms") govern your use of the Nuafi platform ("Platform") operated by Australian Wholesale Fulfilment Pty Ltd ABN [to be inserted] ("Nuafi", "we", "us", "our"), which holds Australian Credit Licence No. 391 828.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Nature of Our Services

Nuafi is an online platform that connects consumers with licensed mortgage brokers. We provide:

• A broker-matching service connecting you with accredited mortgage brokers in your area
• Mortgage calculators and financial tools for general educational purposes
• A consumer portal for tracking home loan enquiries, saved calculations, and property research
• A broker portal for registered mortgage brokers to manage their client relationships

It does not constitute financial advice, credit advice, or any other professional advice. You should obtain independent professional advice before making any financial decision.

3. Eligibility

You must be 18 years of age or older and an Australian resident to use the Platform. By using the Platform, you represent that you meet these requirements.

4. User Accounts

When you create an account, you agree to:

• Provide accurate and complete information
• Keep your login credentials confidential
• Notify us immediately of any unauthorised use of your account
• Take responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Broker Registration

Mortgage brokers registering on the Platform represent and warrant that they:

• Hold a current Australian Credit Licence or are an authorised credit representative under a valid ACL
• Are a current member of the MFAA or FBAA (or equivalent professional body)
• Will provide accurate details including their ACL or credit representative number
• Will comply with all applicable laws and professional standards in their dealings with consumers
• Acknowledge that Nuafi is not responsible for the conduct of brokers listed on the Platform

6. Calculator Tools — Important Disclaimer

The mortgage calculators and financial tools on this Platform:

• Provide estimates only — actual figures will vary based on lender assessment, product terms, and individual circumstances
• Are based on assumed interest rates, assessment rates, stamp duty rates, and other inputs which may not reflect your specific situation
• Do not constitute a credit assessment, pre-approval, or guarantee of any kind
• Should not be relied upon as the basis for any financial decision without independent professional advice

7. Budget Analyser — Statement Upload

When you upload bank or credit card statements to the Budget Analyser tool:

• Your statement data is processed to categorise transactions and generate a spending summary
• Statement data is used only for the purpose of generating your budget analysis
• We use third-party AI services to process transaction descriptions — only transaction descriptions (not amounts or dates) may be sent for categorisation
• You should not upload statements containing sensitive personal information beyond what is necessary for the analysis
• Results are estimates only and may not accurately reflect your financial position

8. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.

We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

9. Intellectual Property

All content on the Platform, including text, graphics, logos, calculator tools, and software, is owned by or licensed to Australian Wholesale Fulfilment Pty Ltd. You may not reproduce, distribute, or create derivative works without our written permission.

10. Limitation of Liability

To the maximum extent permitted by law:

• Nuafi provides the Platform "as is" without warranty of any kind
• We are not liable for any loss or damage arising from your reliance on information provided through the Platform
• We are not responsible for the conduct, advice, or services provided by brokers connected through the Platform
• Our total liability to you for any claim is limited to the amount you paid to use the Platform (if any)

Nothing in these Terms limits any rights you have under Australian Consumer Law that cannot be excluded.

If your complaint is not resolved to your satisfaction, you may contact the Australian Financial Complaints Authority (AFCA) at www.afca.org.au or by phone on 1800 931 678. AFCA provides a free and independent dispute resolution service.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
